Real Estate Liability Transfers
WTS aided the developer of a 32 acre site where an auto parts manufacturing facility was previously situated. The manufacturing operations were primarily contained in three buildings which totaled 206,000 square feet. An additional 7,750 square foot laboratory building used to perform physical testing was located in the rear of the property. In addition a 75,000 gallon water tower was located at the northeast corner of the property.

Industrial activities were conducted on the property from 1900 - 1991.

WTS aided the developer to obtain a determination from the Ohio EPA that the commercial land use standards under Ohio EPA's Voluntary Action Program (VAP) had been met. The developer conducted the voluntary investigation and cleanup of contamination at the approximately 32.35-acre site. VAP-certified professionals on behalf of the developer submitted a no further action letter demonstrating the property meets the applicable standards and the Ohio EPA has issued a release of liability, known as a covenant not to sue, for the property.
Today this property has been redeveloped to contain a number of big box retail outlets, restaurants and other entertainment facilities. Through our assistance and innovative solutions, a contaminated, previously unusable tract of land was able to be redeveloped for the benefit of the developer and the community at large.
